Regular MurthyDotCom and MurthyBulletin readers are aware that the U.S. Department of Labor (DOL) and the U.S. Citizenship and Immigration Services (USCIS) have increased scrutiny of H1B employers. A number of articles on this topic can be found on our website, including H1B Benefit Fraud & Compliance Assessment Signals Change (24 Oct 2008). Many employers, particularly IT consulting companies, are having difficulty obtaining H1B approvals. The DOL is engaging in more frequent investigations of H1B practices to assess whether there are violations of H1B labor condition application (LCA) requirements. Enforcement was elevated with a recent series of arrests of company officials and one indictment against an IT company.

Recent Arrests of Eleven Individuals in Seven States

Federal agents from U.S. Immigration and Customs Enforcement (ICE) recently arrested 11 people in seven states for allegedly submitting false statements and documents in support of H1B petitions. These arrests occurred in Iowa, California, Massachusetts, Texas, Pennsylvania, Kentucky, and New Jersey.

As explained in the ICE news release, the companies involved are sponsors of H1B nonimmigrants. The companies are alleged to have brought the workers to the United States without having positions to fill. They also are alleged to have placed workers in locations for which they did not have LCAs, thus violating prevailing wage restrictions.

Coordinated Effort of Various Federal Agencies in Arrests

The investigations were coordinated by a number of U.S. Government agencies, including: ICE, the USCIS's Fraud Detection and National Security Division (FDNS), the DOL's Office of Inspector General, the U.S. Postal Service Inspection Service, the U.S. Department of State (DOS), and the Social Security Administration's Office of the Inspector General. The investigations were supported by the office of the U.S. Attorney for the Southern District of Iowa.

The companies and their workers are alleged to have submitted false statements and documents in support of their petitions. Since these filings are mailed or wired when submitted, the charges levied include visa fraud, mail fraud, wire fraud, money laundering, and conspiracy. These are very serious charges, with sentences ranging from five to twenty years in prison. Each charge also carries a possible $250,000 fine.

Indictment : $7.4 Million Forfeiture Sought

The Department of Justice (DOJ) issued a ten-count indictment against IT services company, Vision Systems Group, Inc., of New Jersey, for conspiracy and mail fraud involving H1B visas. The indictment seeks $7.4 million in forfeitures against Vision Systems Group, Inc., while sending a warning that other IT companies are under investigation. The indictment alleges, in summary, that Vision Systems Group, Inc. established a branch office in Iowa and filed false H1B and labor certification cases based upon nonexistent Iowa employment. It further alleges that the company paid employees through the Iowa location and made Iowa-based tax filings, notwithstanding the fact that the employees were not working in Iowa. It alleges that cases were filed with false addresses for the employees, that LCA posting notices were made in improper work locations, and other such violations. These arrests and indictment obviously are very serious, both for the individuals and companies involved, as well as for other companies that may have engaged in similar practices. Companies using the H1B program must recognize that we are in a new era of enforcement and scrutiny. Business practices that may have been overlooked in the past are now leading to DOL investigations and arrests. Employers must review their practices and revise their systems to ensure compliance with the law, including H1B requirements.

On November 14, 2007, the Senate passed the following resolution:
Whereas Diwali, a festival of great significance to Indian Americans and South Asian Americans, is celebrated annually by Hindus, Sikhs, and Jains throughout the United States;
Whereas there are nearly 2,000,000 Hindus in the United States, approximately 1,250,000 of which are of Indian and South Asian origin;
Whereas the word ``Diwali'' is a shortened version of the Sanskrit term ``Deepavali'', which means ``a row of lamps'';
Whereas Diwali is a festival of lights, during which celebrants light small oil lamps, place them around the home, and pray for health, knowledge, and peace;
Whereas celebrants of Diwali believe that the rows of lamps symbolize the light within the individual that rids the soul of the darkness of ignorance;
Whereas Diwali falls on the last day of the last month in the lunar calendar and is celebrated as a day of thanksgiving and the beginning of the new year for many Hindus;
Whereas for Hindus, Diwali is a celebration of the victory of good over evil;
Whereas for Sikhs, Diwali is feted as the day that the sixth founding Sikh Guru, or revered teacher, Guru Hargobind, was released from captivity by the Mughal Emperor Jehangir; and
Whereas for Jains, Diwali marks the anniversary of the attainment of moksha, or liberation, by Mahavira, the last of the Tirthankaras (the great teachers of Jain dharma), at the end of his life in 527 B.C.: Now, therefore, be it
Resolved, That the Senate--
(1) recognizes the religious and historical significance of the festival of Diwali; and
(2) in observance of Diwali, the festival of lights, expresses its deepest respect for Indian Americans and the Indian diaspora throughout the world on this significant occasion.

New Delhi: Gujarat Chief Minister Narendra Modi walked out of an exclusive interview with Karan Thapar on CNN-IBN's Devil's Advocate because he was questioned about Godhra. Narendra Modi walked out of the interview less than five minutes after it started in Gandhinagar on Friday.
Here's an excerpt from the interview.
Karan Thapar: Hello and Welcome to Devil's Advocate. Does the Chief Minister of Gujarat have an image problem and can he win another election and become the Chief Minister again? Those are the two key issues I shall explore today in an exclusive interview with the Chief Minister himself Narendra Modi.
Mr Narendra Modi lets start by talking about you. In the six years that you have been the Chief Minister of Gujarat Rajeev Gandhi foundation has declared Gujarat to be the best administered state. WASHINGTON - USCIS announced today that it has experienced a tremendous increase in the number of applications filed, which has resulted in a front log of cases awaiting data-entry. USCIS is making every effort to address the delay.
USCIS will prioritize data entry for specific form-types. Delay in data entry and fee receipting will not affect Change of Status or Extension of Stay eligibility, assuming all other eligibility requirements are satisfied. USCIS would also like to assure its customers that requests for Premium Processing Service will continue to be processed within 15 days, consistent with existing policies and procedures.
The actual received date will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date on Form I-797 is different from the "Notice Date," which also appears on the Notice and identifies the date the receipt notice was actually generated.
U.S. Citizenship and Immigration Service (USCIS) will provide weekly updates to give our customers accurate information about current receipt times and service level commitments. As of the date of this notice, USCIS has completed data entry and has issued receipt notices for applications and petitions received on or before the following dates:

PREDICTIONS FOR OCTOBER 2007 PRIORITY DATESFOR EMPLOYMENT-BASED IMMIGRANT VISAS - GOOD NEWS!By Jan M. PedersonWashington, D.C., Aug. 2, 2007: Government sources have advised us that we can expect more good news when the new pool of visa numbers is released for the fiscal year which begins on October 1, 2007. The priority date information listed is to be taken as educated predictions, not carved in stone. Expect the following:1. Worldwide, other than India and China, EB1, EB2, EB4 and EB5 immigrant visa categories will be current as of October 1, 2007. It may be necessary to retrogress them later in 2007 or 2008.2. EB1 for India and China will likely be current in October, 2007.3. EB2 for India and China will likely have a cut-off date in October 2007 close to the cut-off dates for January 2007, which were: India - January 8, 2003; China -April 22, 2005.4. EB3 cut-off dates for October 2007 also will likely have a cut-off date close to the cut-off dates for January 2007, which were: Worldwide (other than India and China) -August 1, 2002; India -May 8, 2001; China - April 22, 2005.Please note that these are predictions subject to change depending on the number of cases approved by USCIS during the next two months.Other "Visa Gate" Factoids: 1. This means if the Visa Bulletin reflects "U", the per-country limit has been reached.3. The unofficial reports are that the Texas Service Center received approximately 40,000 I-485 applications during the first day or two in July and the Nebraska Service Center received approximately 35,000 I-485 applications during the same period of time.4. During the first eight months of fiscal year 2007 (October 2006 through May 2007) USCIS requested 66,600 EB visa numbers.
